1. Scope and Applicability
These Terms and Conditions (“Terms”) govern purchases made through www.liyabayne.com (the “Website” or “Online Shop”) between Liya Bayne, domiciled in St. Margarethen, Switzerland (the “Seller”), and its customers (the “Customer”).
By placing an order through the Website, the Customer agrees to these Terms.
Any conflicting or additional terms proposed by the Customer shall not apply unless expressly accepted by the Seller in writing.
The Seller may amend these Terms from time to time. The version in effect at the time the Customer places an order shall apply to that order.
Customers are responsible for providing accurate and complete information when placing an order, including billing, shipping and contact information. The Seller shall not be responsible for delays, additional costs or failed deliveries resulting from incorrect or incomplete information provided by the Customer.
The Seller offers international shipping to countries and regions made available during checkout. Availability of shipping to a particular destination may change at any time.
The Privacy Policy published on the Website applies to the processing of personal data.
2. Products
The subject of the contract is the purchase of products offered through the Online Shop.
The Seller makes reasonable efforts to display and describe products as accurately as possible. However, colors, textures, materials and other visual details may appear differently depending on the Customer's screen, device, lighting conditions or other technical factors.
Product images are for illustrative purposes and do not constitute a guarantee that every visual detail will appear exactly as displayed.
Due to the nature of handmade products, minor variations in appearance, stitching, measurements, placement, color or finishing may occur. Such minor variations are not considered defects where they do not materially affect the intended use or quality of the product.
Customers are responsible for reviewing product descriptions, materials, sizing information and care instructions before placing an order.
3. Orders and Formation of Contract
Products may be added to the shopping cart and purchased through the checkout process on the Website.
By completing checkout and submitting an order, the Customer makes a binding offer to purchase the selected products.
After the order has been submitted, the Customer may receive an automated confirmation acknowledging receipt of the order. Unless expressly stated otherwise, this acknowledgement does not constitute acceptance of the order.
A binding contract is formed when the Seller expressly accepts the order, confirms shipment or dispatches the products, whichever occurs first.
The Seller reserves the right to refuse or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment issues, obvious pricing or product information errors, or shipping restrictions.
If the Seller cancels an order after payment has been received, the amount paid for the cancelled products will be refunded using the original payment method, unless otherwise agreed with the Customer.
4. Prices, Taxes and Import Charges
Prices are displayed in the currency indicated on the Website.
The prices and taxes shown during checkout apply to the order, subject to correction of obvious errors.
The Seller reserves the right to change prices at any time. Price changes do not affect orders that have already been accepted.
For international orders, customs duties, import VAT, taxes, brokerage fees, handling fees or other charges may be imposed by the destination country.
Unless expressly stated otherwise during checkout, such charges are not included in the product price or shipping costs and are the responsibility of the Customer.
The Seller has no control over charges imposed by customs authorities or other third parties and cannot predict their amount.
Customers are responsible for ensuring that the products they order may lawfully be imported into and delivered to their destination country.
5. Payment
Payment must be made using one of the payment methods offered during checkout.
Depending on availability and the Customer's location, accepted payment methods may include credit or debit cards, PayPal or other payment providers displayed at checkout.
Orders will generally be processed only after successful payment authorization or receipt of payment.
The Seller reserves the right to cancel an order if payment cannot be successfully processed or verified.
Payments processed by third-party payment providers may additionally be subject to the respective provider's terms and privacy policies.
6. Shipping and Delivery
The Seller ships to the destinations made available during checkout.
Shipping costs are displayed during checkout before the Customer submits the order. Domestic shipping within Switzerland may be charged at the rate displayed in the Online Shop.
Delivery times displayed on the Website or communicated to the Customer are estimates unless expressly agreed otherwise.
International delivery times may vary depending on destination, customs processing, carrier delays, public holidays and other circumstances outside the Seller's reasonable control.
The Customer is responsible for providing a complete and accurate delivery address.
If a shipment is returned to the Seller because the Customer provided an incorrect or incomplete address, failed to collect the parcel, refused delivery without a valid legal reason, or otherwise caused the delivery to fail, the Seller may deduct reasonable additional shipping or return costs from any amount refundable to the Customer, to the extent permitted by applicable law.
Risk of loss or damage passes to the Customer at the time required by applicable law. Nothing in these Terms limits any mandatory consumer rights relating to loss or damage during delivery.
Customers should inspect their shipment after delivery and notify the Seller promptly if the package or products arrive damaged.
7. Warranty, Defective Products and Liability
Customers should notify the Seller of defective, damaged or incorrectly supplied products as soon as reasonably possible after discovering the issue.
Claims should be submitted by email to info@liyabayne.com and should include the order number, a description of the issue and, where reasonably possible, photographs showing the defect or damage.
Where a product is confirmed to be defective, damaged or incorrectly supplied, the Seller will provide an appropriate remedy, which may include repair, replacement, price reduction or refund, depending on the circumstances and the Customer's rights under applicable law.
Where required by applicable law, reasonable costs associated with returning a defective or incorrectly supplied product will be borne by the Seller.

Nothing in these Terms excludes or limits statutory warranty rights or other consumer rights that cannot legally be excluded or restricted.
To the maximum extent permitted by applicable law, the Seller shall not be liable for indirect, incidental, special or consequential damages arising from the purchase or use of products.
Information regarding materials and product composition is provided to enable Customers to make an informed purchasing decision. Individual sensitivities and allergic reactions may vary. Customers with known allergies or sensitivities should review the product information before use and contact the Seller if additional material information is required.
Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.
The Seller does not guarantee uninterrupted or error-free availability of the Website and shall not be liable for temporary technical interruptions, maintenance or electronic errors outside the Seller's reasonable control.
8. Returns and Right of Withdrawal
Customers may request a return within 14 days after receiving their order, unless a longer period or different right is required under applicable mandatory consumer protection law.
To initiate a return, the Customer must contact the Seller at info@liyabayne.com within the applicable return period and follow the return instructions provided by the Seller.
Unless otherwise required by applicable law, returned products must be:
Products showing signs of wear, use, washing, stains, odors, damage or alterations may be refused or may be subject to a deduction reflecting any reduction in value, to the extent permitted by applicable law.
Underwear and Intimate Items
For hygiene reasons, underwear and other intimate products must be returned unused, unworn, unwashed and in their original condition with all original tags attached.
Underwear or intimate products showing signs of having been worn, used, washed, stained, soiled, damaged or otherwise handled beyond what is permitted under applicable law may be refused for return.
Nothing in this provision restricts any statutory right of withdrawal or other mandatory consumer right applicable to the Customer.
Made-to-Order and Personalized Products
Products made according to the Customer's individual specifications, measurements or personalization requests may be excluded from voluntary returns and statutory withdrawal rights where permitted by applicable law.
This exclusion does not apply where the product is defective, damaged, incorrectly supplied or where applicable law provides otherwise.
Return Shipping
Unless a product is defective, damaged or incorrectly supplied, the Customer is responsible for the direct cost of returning the product, unless applicable law requires otherwise.
Customers are responsible for packaging returned products appropriately. The Seller recommends using a trackable shipping method for international returns.
Refunds
After receiving and inspecting a return, the Seller will determine whether it meets the applicable return conditions.
Where the Customer is legally entitled to a monetary refund, the refund will be processed in accordance with applicable law and generally using the original payment method.
Where no statutory right to a monetary refund exists and the return is accepted under the Seller's voluntary return policy, the Seller may provide store credit instead.
Where required by applicable law, standard outbound delivery costs will also be refunded. Additional costs resulting from the Customer choosing a more expensive delivery method than the standard delivery option offered by the Seller need not be refunded where permitted by law.
Customs duties, import taxes and third-party processing charges are generally not refundable by the Seller, as these amounts may be collected by governmental authorities or third parties. Customers may contact the relevant authority regarding possible reimbursement.
Nothing in this Returns Policy limits or excludes mandatory consumer rights under applicable law.
9. Cancellations Before Shipment
Customers may contact the Seller at info@liyabayne.com to request cancellation of an order before shipment.
The Seller cannot guarantee that an order can be cancelled once it has been submitted, as processing may begin immediately.
If cancellation is possible and accepted by the Seller, payments already received for the cancelled products will be refunded using the original payment method.
Any mandatory statutory cancellation or withdrawal rights remain unaffected.
10. Care, Sizing and Product Use
Customers should follow all care instructions provided with the product or on the Website.
Sizing information is provided as guidance. Customers are responsible for selecting their preferred size based on the measurements and sizing information provided.
A product being unsuitable due solely to an incorrectly selected size does not constitute a product defect. Any applicable return or withdrawal rights remain unaffected.
Products should only be used for their intended purpose.
11. Data Protection
Personal data is processed in accordance with the Privacy Policy published on the Website and applicable data protection laws.
The Customer is responsible for ensuring that the information submitted during checkout is accurate.
12. Intellectual Property
Unless otherwise indicated, the Website and its contents, including photographs, product images, videos, graphics, designs, logos, text and other materials, are owned by or licensed to the Seller and are protected by applicable intellectual property laws.
Content may not be reproduced, copied, modified, distributed, published, commercially exploited or otherwise used without prior written permission from the Seller, except where permitted by law.
Purchasing a product does not transfer any intellectual property rights relating to the product, Website, photographs, designs or other content to the Customer.
13. Force Majeure
The Seller shall not be responsible for delays or failure to perform obligations caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, civil unrest, strikes, epidemics, governmental measures, customs delays, transportation disruptions, carrier interruptions or failures of telecommunications or infrastructure.
This provision does not affect any rights that cannot be excluded under applicable consumer protection law.
14. Governing Law and Jurisdiction
These Terms and contractual relationships with the Seller are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
This choice of law does not deprive consumers of any mandatory consumer protection rights that apply to them under the laws of their country of residence and that cannot legally be waived by agreement.
Subject to mandatory consumer protection and jurisdiction rules, disputes shall be subject to the jurisdiction of the competent courts at the Seller's registered office in Switzerland.
15. Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.
Where possible, the invalid or unenforceable provision shall be interpreted or replaced in a manner that most closely reflects its intended economic and legal purpose while remaining lawful.
