1. Scope and Applicability

These Terms and Conditions (“Terms”) govern all contractual relationships between Liya Bayne, domiciled in St. Margarethen, Switzerland (the “Seller”), and its customers (the “Customer”) regarding products offered through the website www.liyabayne.com (the “Website” or “Online Shop”).

These Terms apply exclusively. Any conflicting or deviating terms proposed by the Customer shall not be binding unless expressly accepted by the Seller in writing.

The Seller reserves the right to amend or supplement these Terms at any time. The version in effect at the time the Customer submits an order shall apply.

Customers agree to provide accurate and complete information during the ordering process. The Seller reserves the right to reject orders containing false or incomplete information and assumes no liability for inaccuracies provided by the Customer.

The Seller delivers worldwide.

The Privacy Policy published on the Website forms an integral part of these Terms.

2. Subject Matter of the Contract

The subject of the contract is the purchase of goods offered through the Online Shop.

Product images displayed on the Website are for illustrative purposes only. Colors and details may differ from the actual product due to technical limitations. Images do not constitute binding representations or guarantees of product characteristics.

3. Formation of Contract

Products may be placed in the shopping cart through the Online Shop interface. By completing checkout and submitting payment, the Customer makes a binding offer to purchase.

After submission, the Customer receives an automated order confirmation email acknowledging receipt of the order. This email does not constitute acceptance of the offer.

A binding contract is formed only when the Seller sends a separate electronic shipping or order confirmation.

Orders are shipped only after full payment has been received.

The Seller reserves the right to withdraw from the contract, even after acceptance, if products become unavailable for reasons beyond its control. In such cases, the Customer will be informed promptly and refunded within 30 days. The Seller may offer an equivalent replacement product.

4. Prices and Taxes

All prices listed on the Website are gross prices. Price changes and pricing errors are reserved.

5. Payment and Shipping Conditions

Payment must be made in advance during checkout via accepted payment methods such as credit card, PayPal, or Twint.

Shipping is available worldwide and occurs only after confirmed payment.

Domestic shipping within Switzerland is CHF 9.00. International shipping costs vary. Customs duties, taxes, and processing fees are the responsibility of the Customer.

Risk transfers to the Customer once the goods are handed to the shipping carrier.

6. Shipping Time

Estimated shipping times are provided in the shipping confirmation and are non-binding.

If a product becomes unavailable after ordering, the Customer will be notified without delay.

7. Warranty and Liability

The warranty period for asserting defects is 10 days from receipt of the goods.

Defects must be reported in writing within 5 business days of discovery by email to info@liyabayne.com, including a description and photographic evidence.

If a defect is confirmed, the Seller will attempt to replace the item with an equivalent defect-free product. The Seller covers shipping of the replacement; the Customer covers return shipping. If replacement is not possible, the Customer receives a store credit equal to the purchase value.

Warranty claims are excluded in cases of:

• Improper use, accidents, unauthorized repairs, or alterations
• Washing or wearing garments beyond normal fitting
• Normal wear and aging

Liability for indirect or consequential damages is excluded to the extent permitted by law. The Seller is not liable for shipping damage caused by carriers once goods are handed over.

Liability for allergic reactions is excluded; responsibility lies with the manufacturer.

The Seller does not guarantee uninterrupted availability of the Website and is not liable for technical interruptions or electronic errors during ordering.

8. Returns and Right of Withdrawal

Customers may return unused goods within 10 days of receipt without stating reasons.

Returned items must be unopened or show no signs of use. The Customer must notify the Seller by email within the return period and ship the goods back within the same timeframe.

Approved returns are compensated via store credit equal to the product value. Cash refunds are excluded. Return shipping costs are borne by the Customer.

Customers are responsible for any reduction in value resulting from improper handling.

9. Data Protection

Customer data is treated confidentially. Processing of personal data is governed by the separate Privacy Policy available on the Website.

10. Intellectual Property

All content displayed on the Website, including product images, is protected by intellectual property rights owned by the Seller or third parties. Use without prior written permission is prohibited.

11. Final Provisions

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of the Customer’s country of residence remain unaffected.

The place of jurisdiction is the competent court at the Seller’s registered office in Switzerland, unless mandatory law provides otherwise.

If any provision of these Terms is found invalid, the remaining provisions remain unaffected. The invalid clause shall be replaced by a lawful provision reflecting the original intent as closely as possible.
